NOTICE TO BIDDERS

 Notice is hereby given that sealed proposals will be received by the Borough of Bound Brook, Somerset County, New Jersey for The Reconstruction of High Street and opened and read in public at the Municipal Building, 230 Hamilton Street, Bound Brook, New Jersey on Tuesday, September 14, 2010 at 10:00 AM prevailing time.

 Contract Documents and Plans for the proposed work, prepared by(Engineer's Name), (Municipal Title, if Applicable), Robert R. Keady, Jr., P.E., C.M.E. of the firm of T&M Associates, Consulting and Municipal Engineers, Eleven Tindall Road, Middletown, New Jersey 07748, are on file in the office of the Engineer (REVISE OR SUPPLEMENT IF PLANS ARE NOT ON FILE IN THE ENGINEER'S OFFICE OR ARE ALSO ON FILE IN ADDITIONAL LOCATIONS), and may be inspected by prospective bidders during business hours.

 Bidders will be furnished with a copy of the contract documents and plans by the Engineer (REVISE IF DOCUMENTS ARE BEING FURNISHED BY SOMEONE ELSE) upon proper notice and payment of a non-refundable charge of One HundredDollars ($100.00) to defray the cost thereof.

 Proposals must be made on the Standard Proposal Forms in a manner designated in the contract documents, must be enclosed in a sealed envelope bearing the name and address of the bidder and the name of the work on the outside, addressed to the Borough of Bound Brook and must be accompanied by all items identified in the Contract Documents including, but not limited to, a Statement of Consent of Surety from a surety company holding a Certificate of Authorization to do business in the State of New Jersey (*and listed in Treasury Department Circular 570) and a bid guarantee (Proposal Security) for not less than ten percent (10%) of the amount bid except that the guarantee need not exceed $20,000.00.

*Note:  normally Insert this phrase in parenthesis only when Federal Funds are involved in the project.

**NOTE:  THE BID GUARANTEE AND/OR CONSENT OF SURETY MAY NOT BE REQUIRED ON CONTRACTS UNDER $100,000 AT THE OPTION OF THE OWNER.

 Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.

only FOR CONTRACTS EXEMPT FROM PUBLIC BIDDING INCLUDE THE FOLLOWING IN LIEU OF THE ABOVE:  IF AWARDED A CONTRACT, YOUR COMPANY/FIRM SHALL BE REQUIRED TO COMPLY WITH THE REQUIREMENTS OF N.J.S.A. 10:5-31 ET SEQ. AND N.J.A.C. 17:27.

 Bidders are also required to comply with other provisions of Law including, but not limited to, the requirements of:

 N.J.S.A. 52:25-24.2 (P.L. 1977, c.33, Disclosure of Ownership)

  • N.J.S.A. 52:32-44 (P.L. 2004, c. 57, Business Registration)
  • N.J.S.A. 34.11-56.25, et seq. (P.L. 1963, c. 150, Prevailing Wages)
  • N.J.S.A. 34.11-56.48 (Public Works Contractor Registration)

 The contract shall not be approved until a favorable eligibility determination has been made by the New Jersey Department of Transportation.
